Welcome to SendAPhoto. These Terms of Service ("Terms") govern your use of the SendAPhoto app and the sendaphoto.app website (together, the "Service"), provided by Cosmocode. By using the Service, you agree to these Terms.

1. Acceptance of terms

By downloading, installing, or using SendAPhoto, or browsing sendaphoto.app, you confirm you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Service.

2. Description of the service

SendAPhoto is an app that transfers photos and videos directly between devices on the same local Wi-Fi network, without passing through a server (peer-to-peer transfer). The Service includes a FREE plan (up to 500 photos total, ad-supported, including initial use without registration) and a paid PRO plan, as described in the app and on the website.

3. Accounts and registration

You can use some basic features without creating an account. Once you pass the free usage threshold, continuing to use the Service requires an email address (no password). You are responsible for the accuracy of the information you provide and for keeping access to your account secure.

4. Purchases and billing (PRO plan)

The PRO plan is a one-time, fixed-duration purchase (30 or 365 days depending on the product chosen), not an auto-renewing subscription: no recurring charge ever happens without a new, explicit action from you.

Once the purchased duration expires, the plan automatically reverts to FREE; we send email reminders before expiry.

Purchases are processed entirely by the Apple App Store or Google Play: refund requests should be directed to the platform through which the purchase was made, under its own policies.

5. Acceptable use

You agree to use the Service only for lawful purposes and not to:

• use the Service to transfer illegal, defamatory content, or content that infringes third-party rights;
• attempt to tamper with, reverse-engineer, or circumvent the app’s security measures or plan limits;
• use the Service in a way that damages, overloads, or compromises SendAPhoto’s infrastructure or other users.

6. Termination and account deletion

You can delete your account at any time from the app’s Settings, or from this site’s Delete account page. Deletion permanently removes the data associated with your account, as described in the Privacy Policy.

We reserve the right to suspend or terminate access to the Service in case of a breach of these Terms.

7. Disclaimer of warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including (without limitation) fitness for a particular purpose or freedom from interruptions or errors.

8. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, or consequential damages arising from use or inability to use the Service, including any loss of data or files during transfer.

9. Changes to these terms

We may update these Terms from time to time. The "last updated" date at the top of the page shows when they were last changed. Continued use of the Service after a change means you accept the updated version.

10. Governing law

These Terms are governed by [Jurisdiction to be specified]. Any disputes will be subject to the exclusive jurisdiction of the courts of that jurisdiction, without prejudice to any mandatory consumer rights under applicable law.
